1. Who we are

kukubuy.com ("the Site") is operated by KukuBuy, a United States-based online retailer located at 1200 Tech Park Drive, Suite 210, Austin, TX 78701. "You" means any visitor or customer of the Site.

2. Orders and order acceptance

Placing an order on the Site is an offer to purchase. Your order is accepted — and a contract formed — when we send the shipping confirmation email. We may decline or cancel an order (with a full refund) if the product is out of stock, if pricing was displayed in error, if we suspect fraud, or if the order appears to be for resale without a wholesale agreement.

3. Pricing and payment

All prices are in US dollars and apply to shipments within the United States. Prices and promotions may change without notice; the price shown at the time of your order is the price that applies. Sales tax, where applicable, is calculated based on your shipping address and shown on your invoice. Payments are processed by third-party payment processors; by submitting payment information you authorize the charge for your order total.

4. Shipping and delivery

Shipping times and rates are described in our Shipping Policy. Delivery dates are estimates and not guarantees; carrier delays are outside our control. Risk of loss passes to you upon carrier delivery confirmation.

5. Returns and warranty

Returns are governed by our Returns & Refunds policy (30 days, full refund, conditions apply). All products carry a 1-year warranty against manufacturing defects. The warranty is your exclusive remedy for defective products, and applies to the original purchaser only.

6. Acceptable use

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Site or its systems; (c) scrape, copy or republish the Site's content, product images or descriptions without our written permission; (d) interfere with the operation of the Site; or (e) place fraudulent orders or misuse promo codes.

7. Intellectual property

All content on the Site — text, product imagery, logos, layout and code — is owned by KukuBuy or its licensors and protected by United States and international intellectual-property laws. You may not reproduce, distribute or create derivative works without prior written consent.

8. Product information & “was” pricing

We work hard to describe products accurately, but we do not warrant that descriptions, images or specifications are error-free. Where a "compare at" price is shown, it reflects the price at which the same or a comparable item is generally sold elsewhere, or our previous selling price, in the preceding 90 days. Product colors may appear differently depending on your screen.

9. Disclaimer of warranties

Except for the express 1-year warranty and any non-waivable rights under applicable law, the Site and its products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, KukuBuy's total liability arising out of or relating to any order or use of the Site will not exceed the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Governing law & disputes

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Travis County, Texas, and both parties consent to venue there. Nothing in this section prevents you from bringing a claim in small-claims court where eligible.

12. Changes to these terms

We may update these terms from time to time. The version in effect when you place an order governs that order. Continued use of the Site after an update means you accept the revised terms.
